What are the rules for overtime workers in Malaysia?

In Malaysia, the maximum number of overtime hours an employee can work in a month is 104 hours. This limit is intended to prevent employee burnout and ensure a healthy work-life balance.

Here are some other overtime-related rules in Malaysia:

  • Employers must pay overtime for any work that exceeds the 45-hour weekly limit.
  • Employees earning more than RM4,000 per month are not required to work overtime unless their employment contract specifies it.
  • Employers cannot require employees to work more than 12 hours in a single day, including overtime.
  • Hours worked on rest days, public holidays, or substituted paid holidays do not count towards the 104-hour limit.

Companies should comply with the Employment Act and Industrial Relations Act when creating overtime policies.
